2. Product Safety & Usage
Choking Hazard Warning: EmoTee "feelings patches" are small, removable components. These products are NOT suitable for children under 36 months (3 years) due to small parts which pose a choking hazard.
Supervision: Children should be supervised by an adult at all times while wearing EmoTee garments or using the feelings patches. EmoTee Ltd accepts no liability for misuse or accidents resulting from unsupervised use.
Educational Purpose: EmoTee products and our "Feelings Patches" are intended as educational wellbeing tools. They are not a substitute for professional medical, psychological, or psychiatric advice, diagnosis, or treatment.
3. Orders and Contract Formation
Ordering: When you place an order, you will receive an acknowledgement email. This is not an acceptance of your order.
Contract: A legally binding contract between us is only formed when we send you a "Shipping Confirmation" email.
Pricing: All prices are in GBP. As children’s clothing is generally zero-rated for VAT in the UK, VAT is not charged on our core garments.
4. Delivery and Shipping
Timeline: We aim to dispatch orders within 5 working days.
Risk: Once the goods have been delivered to the address you provided, the risk of loss or damage passes to you.
Delays: If delivery is delayed by events outside our control, we will contact you as soon as possible to let you know.
5. Returns and Right to Cancel
14-Day Cooling Off: Under the UK Consumer Contracts Regulations, you have the right to cancel your order within 14 days of receiving your goods without giving a reason.
Condition of Returns: To receive a full refund, items must be returned unworn, unwashed, and in their original packaging with all patches included.
Refunds: We will process your refund within 14 days of receiving the items back. You are responsible for the cost of return postage unless the item is faulty.
6. Intellectual Property
Trademark: "EmoTee" and the EmoTee logo are trademarks of EmoTee Ltd.
Copyright: All designs, text, and the "Feelings Patch" system are the intellectual property of EmoTee Ltd. You may not reproduce, copy, or distribute any part of our brand or products without written permission.
7. Limitation of Liability
Maximum Cap: To the fullest extent permitted by law, EmoTee Ltd’s total liability to you for any loss or damage arising out of our products or website shall be limited to the total amount paid for the product in question.
Excluded Losses: We are not liable for any indirect, special, or consequential losses.
Legal Compliance: Nothing in these terms seeks to exclude or limit any liability which cannot be excluded or limited under applicable UK law.
8. Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
